IMPORTANT INFORMATION REGARDING CONFIDENTIAL STUDENT DATA
A recent lawsuit against the California Department of Education (CDE) is impacting all school districts across the state, including San Joaquin County students.
In April 2012, two organizations, the Morgan Hill Concerned Parents Association and the Concerned Parent Association, filed a lawsuit against the CDE alleging widespread, systemic non-compliance by local education agencies with special education laws. The suit also alleges the CDE fails to monitor, investigate, and correct such non-compliance in accordance with the law. The CDE denies these allegations and is actively defending the litigation.
San Joaquin County Office of Education schools and programs were not involved in the lawsuit and are not the subject of any of the suit's allegations. The San Joaquin County Office of Education will not be giving out student information.
Nonetheless, CDE as a part of this lawsuit has been ordered by the court to release all the data it has collected on general and special education students since Jan. 1, 2008.

Una reciente demanda judicial en contra el Departamento de Education de California esta impactando todos los distritos escolares a través del estado, incluyendo los estudiantes del condado de San Joaquín.
En abril del 2012, dos organizaciones, la Asociación de Padres Afectados de Morgan Hill y la Asociación de Padres Afectados, entablaron una demanda legal en contra del CDE acusándolo de incumplimiento sistémico generalizado por parte de agencias locales de educación en cuanto a las leyes de educación especial. La demanda alega que el CDE no cumple con monitorear, investigar y corregir el dicho incumplimiento de acuerdo a lo estipulado por la ley. La CDE niega dichas acusaciones y está defendiendo el litigio activamente.
Las escuelas y programas de la Oficina de Educación del Condado de San Joaquín no participaron en la demanda judicial y no son el sujeto de ninguna de las alegaciones de la demanda. La Oficina de Educación del Condado de San Joaquín no va a proporcionar información estudiantil.
Sin embargo, como parte de esta demanda, la corte ha ordenado a la CDE de divulgar todos los datos que ha recopilado en cuanto a estudiantes generales y de educación especial desde enero 1 del 2008.
